Fannin County Criminal District Attorney Richard Glaser released a list of people who entered plea agreements with his office during the April dockets before Judge Laurine Blake of the 336th District Court of Fannin County. The following individuals either entered guilty pleas and accepted responsibility for their conduct without further court action or went to trial and a Fannin County Jury rendered the verdict and sentence indicated.
Jonathan Bilbrey, 18, of Bonham, TX pled true to the allegations contained in the State*s Motion to Adjudicate Guilt was convicted and sentenced to 2 years incarceration in the Texas Department of Criminal Justice 每 State Jail Division and assessed court costs in the amount of $304 for the State Jail Felony offense of Burglary of a Building committed on October 26, 2011. Bilbrey*s sentence shall run concurrent with his other two Fannin County sentences.

Kristy Lynn Brese, 30, of Bonham, TX pled guilty to the State Jail Felony offense of Possession CS PG 1 <1G. On December 18, 2012, Brese was stopped by the Fannin County Sheriff*s Office for a minor traffic violation. The officer become concerned that Brese possessed some form of contraband. He requested and was granted consent to search the vehicle. The search revealed less than one gram of methamphetamine which Brese admitted to owning. Brese was convicted and sentenced to 2 years incarceration in the Texas Department of Criminal Justice 每 State Jail Division, assessed restitution in the amount of $ 140 for drug testing and court costs in the amount of $374. The court then suspended Brese*s sentence and placed her on Community Supervision for a period of 4 years.
Jimmy Caplinger, 41, of Bonham, TX pled guilty to the 3rd Degree Felony offense of Theft of Property ≡$20,000 <$100,000. Caplinger*s wife, Tabitha, was employed at the Fannin County Electric Cooperative, Inc. as a billing clerk. During the course of her employment, Mrs. Caplinger embezzled funds in excess of $800,000. Mr. Caplinger was unaware of his wife*s theft for a long period of time but during the marriage he became aware of the theft and began to knowingly use the stolen funds for his personal gain. In the years of 2010 and 2011, Mr. Caplinger gambled more the 3 times his annual income at the Choctaw Casino in Durant, OK. Caplinger was placed on 10 years deferred adjudication probation, ordered to pay restitution in the amount of $91,000 and court costs in the amount of $334.
Tabitha Caplinger, 41, of Bonham, TX pled guilty to the 1st Degree Felony offense of Theft of Property ≡$200K. Caplinger was employed at the Fannin County Electric Cooperative, Inc. as a billing clerk. Caplinger, because she was supposed to be cross-training other members of the billing department, gained special access to the billing system allowing her to manually manipulate bills and post payments. During a four-year period, Caplinger stole $831,357.48 in cash payments made by FCEC customers. Caplinger hid her theft by overcharging large municipal and corporate customers〞specifically the City of Irving, Texas. Caplinger*s theft was discovered because she was refusing to take vacation, which led to a suspicion she was stealing. After an audit, Caplinger admitted to the theft to officials with FCEC and police. In the years of 2010 through 2012, Caplinger gambled over $1 million at the Choctaw Casino in Durant, OK. Caplinger was convicted and sentenced to 7 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division, assessed restitution in the amount of $831,357.48 and court costs in the amount of $334. Caplinger petitioned the court to remain free on bond until her child*s high school graduation; based on Caplinger*s performance on bond the court granted that request and she was ordered to begin her sentence on June 8, 2013.
Michael Lewis Clark, 24 of Savoy, TX pled guilty to the State Jail Felony offense of Unauthorized Use of a Vehicle. On October 30, 2012, Clark and his girlfriend began arguing due to his intoxication. Clark took the keys to his girlfriend*s car without her permission and left her apartment causing her to be stranded. Clark refused to return the car for several days until it was finally located with the help of his family at the Post Office in Bells, Texas. Clark was convicted and sentenced to 9 months incarceration in the Texas Department of Criminal Justice 每 State Jail Division and assessed court costs in the amount of $314.
Derrick Shelby Davis, 21, of Bonham, TX pled guilty to the State Jail Felony offense of Theft of Material Alum/Brnze/Copper/Brass <$20K. On February 17, 2013, Davis took a quantity of copper wire from Billy Ray Kizer without Mr. Kizer*s consent. Mr. Kizer noticed the wire was missing and suspected Davis as the culprit due to a recent inquiry regarding the copper. Bonham Police quickly located Davis in the vicinity of Mr. Kizer*s home in possession of the copper wire. Davis was convicted and sentenced to 2 years incarceration in the Texas Department of Criminal Justice 每 State Jail Division, fined $1,000, and assessed court costs in the amount of $249. The court then suspended Davis*s sentence and placed him on Community Supervision for a period of 5 years. As a condition of probation Davis was ordered to remain in custody in the Collin County Jail until he successfully completed the SCORE program administered by that facility.
Jeremy Keith Daugherty, 23, of Telephone, TX pled guilty to the 2nd Degree Felony offense of Burglary of a Habitation. On August 13, 2012, Daugherty entered his father*s residence without permission and committed theft of jewelry and money. Later that same day Daugherty was involved in a motor vehicle accident in Bonham. While investigating the accident officers located the stolen property and Mr. Daugherty admitted to taking it without permission. Daugherty was convicted and sentenced to 10 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division, fined $1,500, assessed restitution in the amount of $2,000 and court costs in the amount of $299. The court then suspended Daugherty*s sentence and placed him on Community Supervision for a period of 10 years. As a condition of probation Daugherty was ordered to the custody of the Texas Department of Criminal Justice until he successfully completed the SAFPF substance abuse program administered by that agency.
Rene Davis, 40, of Ector, TX pled guilty to the State Jail Felony offense of Theft of Property <$1,500 2/More Previous Conviction. On March 14, 2012, Davis, while at Bonham Wal-Mart, was stopped by store security staff after she passed the last point of sale with $100.99 of merchandise. Davis had four prior convictions for misdemeanor theft. Davis was convicted and sentenced to 14 months incarceration in the Texas Department of Criminal Justice 每 State Jail Division and assessed court costs in the amount of $364. Davis*s sentence shall run concurrent with her other Fannin County sentence.
Rene Davis, 40, of Ector, TX pled guilty to the 3rd Degree Felony offense of Bail Jumping and Fail to Appear. On March 14, 2012, Davis was arrested for the state jail felony offense of Theft of Property <$1,500 2/More Previous Conviction. Davis was bonded out of jail, indicted by the Fannin County Grand Jury and ordered to appear before the 336th District Court on July 12, 2012. On July 12, 2012, Davis failed to appear before the 336th District Court as required by her bond. Davis was convicted and sentenced to 4 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division and assessed court costs in the amount of $349. Davis*s sentence shall run concurrent with her other Fannin County sentence.
Juan Flores, 45, of Fort Worth, Texas pled guilty to the 3rd Degree Felony offense of Driving While Intoxicated 3rd or More (Enhanced). On May 18, 2012, Flores was stopped by the Fannin County Sheriff*s Office for speeding. Based on his behavior during the traffic stop, the officer conducted the standardized field sobriety tests. The deputy was concerned that Flores was too intoxicated to operate his vehicle in public. Based on Flores*s performance on those tests he was arrested for DWI. Flores consented to a breath specimen for analysis. Analysis showed Flores*s blood alcohol concentration to be .124 grams of alcohol per 210 liters of breath. Flores had multiple prior DWI convictions and due to his prior felony convictions his 3rd Degree Felony was punished as a 2nd Degree Felony. Flores was convicted and sentenced to 15 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division and assessed court costs in the amount of $389.
Jeremy Floyd, 30, of Bonham, TX pled guilty to the 2nd Degree Felony offense of Assault Int/Reck Breath/Cir Fam Mem Previous Conviction and the 3rd Degree Felony offense of Assault BI Fam/House Mem 2+ w/in 12 Months. On October 24, 2012 in Tarrant County, Texas Floyd assaulted his girlfriend by pushing her and striking her with his fist. After he was arrested, Floyd and his girlfriend left Tarrant County and moved to Bonham, Texas where on December 31, 2012, they became involved in an argument and he again struck her multiple times with his fist, pushed her to the ground and while behind her used his forearm to strangle her, impeding her ability to breath. She was able to escape by biting his hand. Law enforcement arrived and Floyd was arrested. Floyd was previously convicted of a family violence offense on May 14, 2012 in the Municipal Court of Hurst, Texas. In each case, Floyd was placed on 10 years deferred adjudication probation, assessed court costs in the amount of $249 and $299 respectively and prohibited from any contact with his victim as a condition of his probation.
Rachael Danieal Fulgham, 31, of Bonham, TX pled guilty to the State Jail Felony offense of Driving While Intoxicated w/Child Under 15 YOA. On November 22, 2012, Fulgham was stopped by the Trenton Police Department on Texas Hwy 121 based on a call from another driver related to her erratic driving. Based on her behavior during the traffic stop, the officer conducted the standardized field sobriety tests. The officer was concerned that Fulgham was too intoxicated to operate her vehicle in public. Based on Fulgham*s performance on those tests she was arrested for DWI. Fulgham*s three children ages 15, 12, and 9 were present in the vehicle at the time of the stop. A search warrant was obtained for Fulgham*s blood to determine the alcohol concentration. Testing revealed that Fulgham had a blood alcohol concentration of .184 grams of alcohol per 100 milliliters of blood. Fulgham was convicted and sentenced to 2 years incarceration in the Texas Department of Criminal Justice 每 State Jail Division, assessed restitution in the amount of $60 for blood testing and court costs in the amount of $324. The court then suspended Fulgham*s sentence and placed her on Community Supervision for a period of 4 years.
Tommy Lee Gee, II, 41, of Bonham, TX, pled true to the allegations contained in the State*s Motion to Revoke Probation, was convicted, sentenced to serve 7 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division, assessed restitution in the amount of $140 for lab testing, and court cost in the amount of $355 for the State Jail Felony offense of Poss CS PG 1>1G (Enhanced).
Christopher Wayne Holmes, 44, of Trenton, TX pled not guilty to and was acquitted of the offenses of Evading Arrest Detention with a Vehicle Enhanced and Aggravated Assault w/a Deadly Weapon Enhanced.
Holly Amber Horton, 32, of Bonham, TX pled true to the allegations contained in the State*s Motion to Revoke Probation, was convicted, sentenced to serve 6 months confinement in the Fannin County Jail, and assessed court costs in the amount of $314 for the Class A misdemeanor offense of Assault Causes Bodily Injury (Family Violence) committed on May 3, 2012.
Kendele David Shelton King, 18, of Ivanhoe, TX pled true to the allegations contained in the State*s Motion to Adjudicate Guilt, was convicted, sentenced to serve 18 months incarceration in the Texas Department of Criminal Justice 每 State Jail Division, assessed restitution in the amount of $140 for lab testing, and court cost in the amount of $424 for the State Jail Felony offense of Man/Del CS PG 1>1G.
Richard Lee Lewis, 54, of Princeton, TX pled guilty to the 3rd Degree Felony offense of Poss CS PG 1 ≡1G <4G. On August 3, 2007, Lewis was stopped by the Bonham Police Department for operating his vehicle without a seatbelt. During the stop, the officer arrested Lewis due to an open arrest warrant from another jurisdiction. After Lewis was arrested, his vehicle was inventoried and towed for safekeeping. During the inventory a quantity of methamphetamine was discovered and after questioning, Lewis admitted ownership of the methamphetamine. Lewis was convicted and sentenced to 2 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division and assessed court costs in the amount of $351.
Adam Rivera Lopez, 25, of Bonham, TX pled guilty to the State Jail Felony offense of Evading Arrest Detention w/Veh. On March 6, 2011, Lopez after assaulting his wife fled from officers from the Bonham Police Department in his vehicle while they were attempting to arrest him for assaulting his wife. Lopez was convicted and sentenced to 2 years incarceration in the Texas Department of Criminal Justice 每 State Jail Division and assessed court costs in the amount of $309. Lopez*s sentence shall run concurrent with his other Fannin County sentence.

John Robert Manseau, 26, of Honey Grove, TX pled guilty to the State Jail Felony offense of Evading Arrest Detention w/Prev Conviction. On September 23, 2011, Honey Grove Police responded to the 600 block of N. 6th Street to a report of a disturbance. Officers found Manseau and determined that he was intoxicated and attempted to arrest him for public intoxication. Manseau fled from officers who used a taser to stop his flight. Manseau has a prior misdemeanor conviction for Evading Arrest Detention. Manseau was convicted and sentenced to 18 months incarceration in the Texas Department of Criminal Justice 每 State Jail Division and assessed court costs in the amount of $299.

Michael Thomas McClung, II, 33, of Princeton, Texas pled not guilty to the 3rd Degree Felony offense of Assault Int/Reck Impede Breath/Circulation (Enhanced). On September 13, 2009, in Honey Grove, TX, McClung become embroiled in an argument with his then wife which ended in his striking her and strangling her until she lost consciousness. McClung was convicted by a jury and sentenced to 10 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division and ordered to pay court costs in the amount of $455. The State of Texas anticipates that McClung will appeal his conviction.
Brian Keith McDonald, 48, of Bonham, TX pled guilty to 3rd Degree Felony offense of Poss CS PG 2 <1G Drug Free Zone, and the State Jail Felony offense of Poss CS PG 3 <28G Drug Free Zone. On December 6, 2012, McDonald was arrested for misdemeanor theft at Wal-Mart in Bonham, TX. During the investigation of the theft McDonald admitted to possessing prescription Alprazolam and Amphetamine without a valid prescription. McDonald was searched and found to possess prescription Alprazolam in an amount less than 28 grams and Amphetamine in an amount less than one gram. McDonald possessed the contraband within 1,000 feet of Bonham High School, a drug free zone. In each case, McDonald was placed on 5 years deferred adjudication probation, assessed restitution in the amount of $140 for lab testing, and court costs in the amount of $309.
Joshua Nichols, 20, of Bonham, TX pled guilty to 3 counts of Indecency with a Child by Sexual Contact. On or about January 16, 2013, Nichols touched the genitals and anus of a five-year old male relative, and caused the victim to touch Nichols*s genitals. In each case, Nichols was placed on 10 years deferred adjudication probation, assessed court costs in the amount of $599, and required to register as a Sex Offender for the rest of his life.
Ashley Nicole Pierce, 27, of Bonham, TX pled true to the allegations contained in the State*s Motion to Adjudicate Guilt, was convicted, sentenced to 3 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division and assessed court costs in the amount of $275.25 for the 3rd Degree Felony offense of Assault Public Servant committed on February 27, 2004.
Lora Pinder, 19, of Bonham, TX pled guilty to the 3rd Degree Felony offense of Proh Sub Corr Facil-Alcohol/Drug/Prone/Tobacco. On November 7, 2012, while employed as a Correction Officer at the Fannin County Jail, Pinder delivered cigarettes and 2 hydrocodone tablets to an inmate in the jail. Pinder was placed on 10 years deferred adjudication probation, fined in the amount of $2,000, and assessed court costs in the amount of $264.
Lora Pinder, 19, of Bonham, TX pled guilty to the 3rd Degree Felony offense of Proh Sub Corr Facil-Alcohol/Drug/Prone/Tobacco. On November 7, 2012, while employed as a Correction Officer at the Fannin County Jail, Pinder delivered cigarettes and 2 hydrocodone tablets to an inmate in the jail. Pinder was placed on 10 years deferred adjudication probation and assessed court costs in the amount of $264.
Mary Denise Ramirez, 53, of Telephone, TX pled guilty to the State Jail Felony offense of Theft of Prop ≡$1,500 <$20K. On June 19, 2012 Ramirez entered the Ivanhoe General Store during regular business hours, found all employees outside smoking, opened the cash register, and stole $4,231 in United States currency. Ramirez was placed on 2 years deferred adjudication probation, assessed restitution in the amount of $4,231 and court costs in the amount of $264.
Aaron Craig Rutherford, 37, of Bonham, TX pled guilty to the State Jail Felony offense of Poss CS PG 1 <1G. On June 4, 2012, Rutherford was arrested on a related drug delivery charge. After the arrest, his girlfriend granted officers permission to search their home. The search revealed methamphetamine in an amount of less than 1 gram. Rutherford admitted ownership of the controlled substance. Rutherford was convicted and sentenced to 2 years incarceration in the Texas Department of Criminal Justice 每 State Jail Division, assessed restitution in the amount of $140 for drug testing and court costs in the amount of $324. The court then suspended Rutherford*s sentence and placed him on Community Supervision for a period of 3 years.
Sandi Marie Schiler, 35, of Whitewright, TX pled guilty to the State Jail Felony offense of Man/Del CS PG 1 <1G. On October 25, 2012, Schiler delivered .4 grams of methamphetamine to a confidential informant for the Fannin County Sheriff*s Office who was outfitted with a covert digital audio and video recording device which captured the illegal drug transaction. Schiler was convicted and sentenced to serve 2 years incarceration in the Texas Department of Criminal Justice 每 State Jail Division and assessed court costs in the amount of $374. Schiler*s sentence will run concurrent with all other sentences from Fannin County.
Sandi Marie Schiler, 35 of Whitewright, TX pled guilty to the 1st Degree Felony offense of Man/Del CS PG 1 ≡4G <200G. On November 1, 2012, the Fannin County Sheriff*s Office executed a search warrant on Schiler*s home and found a large amount of methamphetamine packaged for distribution. Other items commonly found in the possession of individuals in the drug trade were also found. Schiler was convicted and sentenced to serve 9 years incarceration in the Texas Department of Criminal Justice 每 Institution Division and assessed court costs in the amount of $374. Schiler*s sentence will run concurrent with all other sentences from Fannin County.
Valerie Ann White, 26, of Ector, TX pled guilty to the 3rd Degree Felony offense of Assault Int/Reck Impede Breath/Circulation. On December 24, 2012, White〞while extremely intoxicated〞attacked her husband while he was sleeping by striking him. Being concerned for their child, White*s husband went to check on their 8-month old baby. While he was going to check on the child, White forced her husband against the wall and began to strangle him with her hands interfering with his ability to breath. White*s parents restrained her while law enforcement was notified of the assault. White was placed on 7 years deferred adjudication probation and assessed court costs in the amount of $264.
Michael Ray Williams, 49, of Bonham, TX pled guilty to the 3rd Degree offense of Assault Family/Household Member w/Prev Conv. On December 9, 2012, Mr. Williams was arguing with his 67-year old disabled mother, grabbed her arm and twisted it with his hands causing it to bleed. Williams has previously been convicted of offenses involving family violence. Williams was convicted and sentenced to serve 10 years incarceration in the Texas Department of Criminal Justice 每 Institutional Division and assessed court costs in the amount of $249.
