Criminal District Attorney Richard Glaser reports that on Thursday, June 20, 2013, the Fannin County grand jury met in their final session for its term to consider twenty-eight (28) cases.  The grand jury returned the twenty-seven (27) true bills or indictments listed below.  Of the new felony charges filed, 10 involved possession or manufacturing of drugs.  In the first six months of 2013, a total of 158 new felony cases have been charged in Fannin County. 

District Attorney Glaser reports that the grand jury also heard evidence from local Texas Ranger Brad Oliver concerning the officer involved shooting June 7 on North Highway 78.  The incident resulted in homicide, but the grand jury determined that the use of deadly force under the circumstances was lawful and the DPS officer who shot the individual has been cleared of any criminal wrongdoing.

It is important to note that an indictment is a formal charge and should not be considered as evidence of guilt and that all persons charged with a crime are presumed innocent until proven guilty beyond a reasonable doubt.

The grand jury also accepted the Annual Road Report from each of the Fannin County Commissioners.  These road reports are a public record and also filed with the Commissioners Court each year.    Section 251.005 of the Local Government Code provides Commissioner’s Road Report –
(a) A county commissioner serving as a road supervisor shall make a sworn annual report during the ninth month of the county fiscal year on a form approved by the commissioners court showing:

(1) The condition of each road or part of a road and of each culvert and bridge in the commissioner’s precinct;
(2) The amount of money reasonably necessary for maintenance of the roads in the precinct during the next county fiscal year;
(3) The number of traffic control devices in the precinct defaced or torn down;
(4) Any new road that should be opened in the precinct; and
(5) Any bridges, culverts, or other improvements necessary to place the roads in the precinct in good condition, and the probable cost of the improvements.

 (b) The report shall be entered in the minutes of the commissioners court to be considered in improving public roads and determining the amount of taxes imposed for public roads.

 (c) The report shall be submitted, together with each contract made by the court since its last report for any work on any road, to the Grand Jury at the first term of the District Court occurring after the report is made to the commissioners court.  Excerpts from those reports reflect the following:

Precinct 1 – Commissioner Gary Whitlock reports all roads are open to traffic at this time.  His anticipated budget for road maintenance for the next fiscal year is approximately $724,000 which includes his plan to replace the wooden bridge on CR 1202 with a concrete surface at a cost of $5,000.

Precinct 2 – Commissioner Stan Barker’s anticipated budget for road maintenance for the next fiscal year is $725,000 to maintain the roads at their present level.  Three bridges are to be replaced by TxDOT this year along with one bridge bring being replaced by Precinct 2 at an estimated cost of $40,000.

Precinct 3 – Commissioner Jerry Magness reports all county roads in Precinct 3 are open.  Anticipated budget for road maintenance for the next fiscal year is $1,140,567.  This increase in budget will cover culverts that need replacement and approximately 50 road signs that have been stolen.

Precinct 4 – Since the untimely passing of Commissioner Joe Strong, Commissioner Barker reported for Precinct 4 stating that approximately $737,991 will be needed for maintenance of roads next year which is the same as last year. Texas Manual on Uniform Traffic Control Devise is dictating that traffic control signs will be installed at all intersections by 2015 in addition to all street number signs being replaced by the year 2018.  This is an ongoing project.

A new grand jury for the July-December, 2013, term will be impaneled and sworn in by Judge Laurine Blake of the 336th Judicial District Court on Thursday, June 27, 2013.
