Summary of Special Meeting
The Board of Trustees
Bonham ISD

A Special meeting of the Board of Trustees of Bonham ISD was held June 5, 2009, beginning at 11:30 AM in the Bonham ISD Administration Center, 1005 Chestnut Street, Bonham, Texas 75418.

1.Call To Order
The meeting was called to order at the Bonham ISD Administration Office at 11:30 a.m. by Dr. Randy McBroom. A quorum was present.
Members present for the meeting: Dr. Randy McBroom, Press Cox, Charlotte Kearney, Monica Kissling, Jim Simpson, Bob Thomas, Doyce Taylor, and Sonny Cruse, superintendent.

2. Action Item - Discuss and consider action regarding a real estate transaction involving the softball fields located near the high school.
Motion was made by Jim Simpson and seconded by Doyce Taylor to authorize the superintendent, Sonny Cruse, to work with the city manager of Bonham to complete a deed amendment regarding the 1989 land transaction between Bonham ISD and the City of Bonham to restrictive covenant language required by Civil Action No. 5281. Motion carried 7-0.

(3) Whenever the Commissioner shall receive notice that a district intends to sell, lease or otherwise convey an interest in real property, he shall promptly notify the appropriate local school officials that the following language shall be incorporated into the instrument of conveyance, sale or lease, and further, that failure of the district to comply with this requirement will result in the imposition of sanctions as set out in paragraph J(4): "The further covenant, consideration and condition is that the following restrictions shall in all things be observed, followed and complied with:

"(a) The above-described realty, or any part thereof, shall not be used in the operation of, or in conjunction with, any school or other institution of learning, study or instruction which discriminates against any person because of his race, color or national origin, regardless of whether such discrimination be effected by design or otherwise.

(b) The above described realty, or any part thereof, shall not be used in the operation of, or in conjunction with, any school or other institution of learning, study or instruction which creates, maintains, reinforces, renews, or encourages, or which tends to create, maintain, reinforce, renew or encourage, a dual school system.

"These restrictions and conditions shall be binding upon grantees, lessee, etc., name of grantee, lessee, etc., his heirs, personal representatives and assigns or its successors and assigns, as the case may be, for a period of fifty (50) years from the date hereof; and in case of a violation of either or both of the above restrictions, the estate herein granted shall, without entry or suit, immediately revert to and vest in the grantor herein and its successors, this instrument shall be null and void, and grantor and its successors shall be entitled to immediate possession of such premises and the improvements thereon; and no act or omission upon the part of grantor herein and its successors shall be a waiver of the operation or enforcement of such condition.

"The restriction set out in (a) above shall be construed to be for the benefit of any person prejudiced by its violation. The restriction specified in (b) above shall be construed to be for the benefit of any public school district or any person prejudiced by its violation."

3. Executive Session, Govt. Code 551.074
Motion was made by Doyce Taylor and seconded by Jim Simpson to recess into executive session at 11:32 a.m. Motion carried 7-0.
The Board returned to open session at 12:38 p.m.

A. Discuss personnel matters pertaining to evaluations, duties, terminations, replacements, reassignments, resignations, hiring and additions to the staff.

B. Discussion with school attorney

4. Action Item - Consider approval of items listed in Executive Session.

Motion was made by Jim Simpson and seconded by Doyce Taylor to approve 2009-2010 probationary contracts subject to assignment for Jenny Haggard (Science BHS) and Ronald Brown (Science BHS).

5. ADJOURNMENT

Motion was made by Randy McBroom and seconded by Monica Kissling to adjourn at 12:42 p.m. Motion carried 7-0.
