SHERMAN, TX -- United States Attorney John L. Ratcliffe announced today that a 31-year-old McKinney man has pleaded guilty to federal firearms charges in the Eastern District of Texas.
JAVIER CORTEZ pleaded guilty to being a drug user in possession of a firearm and giving false information to a licensed firearm dealer today before United States Magistrate Judge Don Bush.
According to information presented in court, on May 5, 2004, Cortez filled out an ATF form required to purchase a firearm stating that he was not a user of marijuana, when in fact, he was a marijuana user. Three firearms, along with marijuana, were located in the defendant’s residence on July 13, 2007 during the execution of a search warrant. He was indicted by a federal grand jury in August 2007.
Cortez faces up to 4 years in federal prison and a fine of up to $250,000.00. A sentencing date has not been set.
This case is being investigated by the McKinney Police Department, Bureau of Alcohol, Tobacco, Firearms and Explosives, and handwriting experts from the Texas Department of Public Safety and the United States Secret Service. The case is being prosecuted by Assistant United States Attorneys Errin Martin and Maureen Smith.
